Mandatory Interview for All Employment-Based Green Cards

 

 

USCIS announced on October 28 that it will conduct interviews for all employment-based green card applications commencing October 1. For the past 10 years, USCIS has not conducted interviews unless there was a particular reason to do so. The measure is said to have been adopted to prevent terrorism. However, in reality, it seems like it is part of the broader immigration policy of the Trump Administration.

If interviews are conducts for all employment-based green card applications, the process of obtaining a green card will become more difficult and time consuming. Moreover, USCIS field offices are already backlogged with long wait times due to conducting interviews for citizenship and family based petitions. As such, the time it will take to obtain a green card is likely to become longer as well as leading  to a decrease in number of employment-based immigration.

In addition, in the case of applicants seeking employment-based green cards while being in F-1 status for a long period of time, there will likely be an in-depth investigation into whether any status violations took place during the F-1 period.

Therefore, if you have applied for or looking to apply for an employment based green card, you must bear in mind the potential for longer processing times and to ensure strict adherence to immigration policies.
