[News & Comment] Visa Bulletin: EB-2 Backlog

 

 

 

According to the Visa Bulletin for August 2017, EB-2 (employment-based second preference green card petition) Worldwide final action date is backlogged. It lags even behind EB-3 Worldwide. The final action date for EB-2 as of August, 2017 is April 1, 2015. This reflects the fact that demand at USCIS for EB-2 has increased dramatically in recent times, and the ability for USCIS to take action on pending cases will continue to lag for the remainder of the immigration fiscal year. This means that if you did not file your greed card application in July, while your date was current, you are ineligible to file your green card application until your date becomes current again.

 

For those who are looking to apply for EB-2, there is no need to be too concerned about the backlog as announced in the August Visa Bulletin. The immigration fiscal year starts in October every year, which means that the processing backlog will likely free up when October comes by. That means that your priority date is most likely to be “current” again and you will be able to file the I-140 and I-485 concurrently. For those looking to file before October, you can still proceed to file the I-140 now, and then file the I-485 once your priority date becomes current later in October, as opposed to waiting until you can file both applications concurrently.
